Welcome to MolarMetrics, LLC (“MolarMetrics,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our website, mobile application, and associated services (collectively, the “Services”). By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, do not access or use our Services.

1. Use of Services

Permitted Use-
MolarMetrics grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services solely for their intended purpose: livestock and animal age verification based on dental scans. You must be at least 18 years old or have parental consent to use the Services. 

User Accounts: You are responsible for maintaining the confidentiality of your account login credentials and for all activities under your account. 

Prohibited Use-
You agree not to:

• Use our Services for any unlawful, unauthorized, or fraudulent purpose.

• Sublicense, rent, or sell your access to the Services to others without the expressed, written consent of MolarMetrics, LLC.

• Reverse-engineer, decompile, disassemble, or otherwise attempt to extract or access our source code.

• Transmit malware, viruses, or any other harmful code through our Services.

• Interfere with or disrupt the integrity, performance, or functionality of our Services.

• Use automated systems (e.g., bots) to access or interact with our Services without prior written consent.

2. Intellectual Property

All content, including but not limited to text, graphics, logos, images, software, and databases, is the property of MolarMetrics or its licensors. This content is protected under U.S. and international copyright, trademark, and other intellectual property laws. Any feedback you provide about the Services becomes our property, and we may use it without obligation to you. 

You may not reproduce, modify, distribute, display, or create derivative works from any content without express written permission from MolarMetrics.

3. Data Collection and Privacy

MolarMetrics collects, processes, and uses data as described in our Privacy Policy. By using our Services, you consent to this data collection and use.

4. Accuracy of Results

MolarMetrics provides AI-generated age estimations based on dental imaging analysis. While we strive to ensure the highest level of accuracy, users acknowledge and agree that:

1. No Guarantee of Accuracy – MolarMetrics utilizes artificial intelligence trained on extensive datasets to estimate livestock age. However, results may vary due to factors including, but not limited to, image quality, lighting conditions, dental wear, breed variations, environmental influences, and individual animal differences. MolarMetrics does not guarantee the accuracy, reliability, or completeness of any AI-generated age estimation.

2. Informational Use Only – The age estimations provided by MolarMetrics are for informational purposes only and are not intended to replace professional assessments, veterinary evaluations, or regulatory documentation. Users are solely responsible for verifying AI-generated results through additional means, such as birth records, physical inspections, or expert consultations.

3. Limitation of Liability – MolarMetrics, its owners, affiliates, employees, and partners shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising from the use of, reliance upon, or inability to use the AI-generated results. This includes, but is not limited to, financial losses, regulatory non-compliance, business decisions, or disputes related to the accuracy of an age estimate.

4. No Veterinary or Legal Advice – MolarMetrics does not provide veterinary, legal, or regulatory advice. Users acknowledge that AI-generated estimates are not a substitute for professional expertise, certification, or legally binding documentation required by governing authorities.

5. User Responsibility – By using MolarMetrics, users agree to assume full responsibility for the interpretation and application of AI-generated results. MolarMetrics shall not be responsible for any decisions, transactions, or legal claims based on its output. Users must comply with all applicable local, state, and federal laws when using AI-generated results.

6. Ongoing Model Improvements – MolarMetrics continuously updates its AI models to improve accuracy. However, past results do not guarantee future performance. Users should ensure they are following best practices for image capture and verification to maximize reliability.

By using MolarMetrics, users acknowledge that they have read, understood, and agreed to this Accuracy Disclaimer and accept full responsibility for the use of AI-generated data. MolarMetrics reserves the right to refuse service or invalidate results if we suspect misuse or fraudulent input.

5. Certificates 

MolarMetrics certifications are issued solely by MolarMetrics based on AI-generated age estimations. These certifications are not currently recognized as regulatory or official documentation by any governmental or industry authority.

Users acknowledge that MolarMetrics certifications may not be accepted by third parties, including government agencies, breed registries, or industry organizations. ​

MolarMetrics is actively working to expand recognition and compliance with industry standards. Until then, users are responsible for determining whether a MolarMetrics certification meets their specific needs. MolarMetrics certificates are non-transferable and valid only for the specific livestock and transaction for which they were issued.

Users must not alter or forge MolarMetrics certificates, and any such action may result in legal action.

6. Limitation of Liability

To the maximum extent permitted by law, MolarMetrics, its officers, employees, and agents shall not be liable for:

• Any direct, indirect, incidental, consequential, or exemplary damages arising from your use or inability to use the Services.

• Errors, inaccuracies, or omissions in the Services.

• Unauthorized access to or alteration of your data.

• Any injuries, losses, or damages resulting from the use of the Services in connection with livestock handling, including but not limited to bodily harm, property damage, or loss of animals. 

• Any other matter related to your use of the Services.

You agree to indemnify and hold harmless MolarMetrics from any claims, damages, or losses resulting from your misuse of the Services. Our liability, if any, is limited to the amount you paid for the Services in the past 12 months.

By using the Services, you acknowledge and accept the inherent risks associated with handling livestock, including the potential for serious bodily injury. You agree to take all appropriate safety measures and to use the Services only in safe, controlled environments. MolarMetrics is not a substitute for professional veterinary advice or safe animal handling procedures. 

7. Subscriptions and Payments

All payments are non-refundable except as required by law.

Subscription Terms
Certain features of the Services require a subscription. By subscribing, you authorize MolarMetrics to charge your payment method on a recurring basis. You are responsible for updating your payment information to avoid service interruptions.

Cancellation Policy
Subscriptions automatically renew unless canceled at least 24 hours before the renewal date. No refunds will be issued for partial billing cycles.

8. Termination

MolarMetrics reserves the right to suspend or terminate your access to the Services at its sole discretion, with or without notice, for any violation of these Terms or other lawful reasons. Upon termination, you must cease all use of the Services, and any data may be deleted at our discretion.

Use at your own risk. MolarMetrics is not responsible for any transactions or agreements made through third-party links.

11. AS-IS Basis

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. 

12. Modifications to Terms

We may revise these Terms at any time. Material changes will be communicated through the Services or via email. Continued use of the Services after changes indicates your acceptance of the updated Terms. If you do not agree to updated Terms, you must stop using the Services immediately.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Virginia, excluding conflict of law principles. Any disputes shall be resolved through binding arbitration in Virginia, except where prohibited by law. Arbitration will be conducted under the rules of the American Arbitration Association.

Livestock Data

• Images or videos of livestock or animal dental structures and teeth provided for age verification.

Usage Data

• Device information, IP address, and interaction logs for analytics.

• Photos with Metadata- Images or videos you upload may contain metadata (e.g., location, timestamps). You are responsible for removing this data if desired. We may collect data from third-party integrations you authorize, such as payment processors or analytics tools. You may choose not to provide certain data, but this may limit Service functionality.

2. How We Use Your Information

• To provide and improve our Services, including AI model accuracy.

• For research, analytics, and product development using aggregated data.

• We may use your data to detect and prevent fraud or security threats.

• To communicate updates, billing information, or promotional offers (with opt-out options).

• Aggregated data may be shared with research partners to advance livestock technology, with no personally identifiable information.

3. Data Sharing

• Third-Party Service Providers: For payment processing, analytics, and functionality. We do not sell your personal information to third parties.

• Legal Authorities: When required to comply with applicable laws or protect our rights.

We employ industry-standard measures to protect your information. However, no data transmission over the internet is entirely secure, and we cannot guarantee absolute security. You are responsible for securing your account credentials to prevent unauthorized access.

5. User Rights

• Access and Correction: Users can access or correct personal information via account settings.

• Data Deletion: Users may request deletion of their data by contacting support@molarmetricsai.com. Requests for data deletion may take up to 30 days to process, subject to legal retention requirements.

• You may opt out of marketing communications by clicking the unsubscribe link in emails.

6. Cookies and Tracking

We use cookies for functionality and analytics. You can manage cookie preferences through your browser settings. We may use third-party cookies for advertising purposes, which you can opt out of via industry tools like the Digital Advertising Alliance.

7. Data Retention

Data is retained only as long as necessary to provide Services or comply with legal obligations. Livestock data may be retained for up to 7 years, or longer, to support audits or legal compliance.

8. Children's Privacy

Our Services are not intended for use by individuals under 18. We do not knowingly collect personal information from children. If we learn that we have inadvertently collected such information, we will delete it promptly.

9. International Users 

If you access our Services from outside the United States, you agree that your information will be transferred to and processed in the U.S., where data protection laws may differ from those in your country. By using our Services, you consent to the transfer of your data to the U.S. and its processing under U.S. law.

10. Changes to this Policy

We may update this Privacy Policy periodically. Material changes will be communicated via the Services or email. Continued use of the Services after updates constitutes acceptance of the revised policy. We will notify you of material changes at least 30 days in advance where possible.
